Terms of Service

You must be at least 18 years old and authorized to bind your organization. If you do not agree to these Terms, you may not use the service.

• You are responsible for activity under your account.
• Keep credentials confidential and notify us immediately of suspected compromise.
• One person per login. Shared accounts are not permitted.

• Service is metered in credits. Monthly plans renew automatically unless cancelled.
• Bank transfer is the default payment method. Card, PayPal and Stripe become available as toggled on the checkout page.
• Annual plans receive a discount disclosed at checkout. Promotional codes apply only at checkout and are not retroactive.
• Credits do not expire while your subscription is active and are non-transferable.
• All prices exclude applicable taxes unless stated otherwise. You are responsible for VAT/GST where required.

You agree to comply with our Acceptable Use Policy. Violation may result in suspension or termination without refund.

You retain ownership of all content you upload or generate ("Customer Data"). You grant DigitalSpark a worldwide, non-exclusive license to process Customer Data solely to operate the service.

We process personal data in line with our Privacy Policy and a Data Processing Addendum available on request.

We target 99.9% monthly uptime for active workspaces with a positive credit balance. Service credits for SLA misses are governed by your order form.

• Either party may terminate for material breach not cured within 30 days.
• We may suspend access immediately for security risk, AUP violation or non-payment after 14 days past due.
• Upon termination you may export your data for 30 days; thereafter it is permanently deleted.

The service is provided "as is" without warranties beyond those required by law. To the maximum extent permitted, DigitalSpark is not liable for indirect, incidental, special or consequential damages.

Our aggregate liability is limited to the amounts you paid in the 12 months preceding the claim.

These Terms are governed by the laws of the State of Washington, USA, excluding conflict-of-law rules. Disputes are resolved in the state or federal courts located in King County, WA.

We may update these Terms. Material changes are notified at least 30 days in advance. Continued use after the effective date constitutes acceptance.
